Following an April 27 vote to approve a conditional use permit to rebuild the 1950s-era Miramar Beach Resort, the Dunes on the Beach Condominium Association filed a lawsuit in Pinellas County court June 1 seeking to squash the permit.

The lawsuit doesn’t say why condo residents want to halt construction but cites a lack of “substantial evidence” for the plan and a lack of due process.

The new hotel would be the first on St. Pete Beach since City Commissioners approved a construction moratorium following a 2014 Department of Environmental Protection consent order over the city’s aging sewer infrastructure.
